By accessing or using PulseWork ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

PulseWork reserves the right to modify these Terms at any time. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

PulseWork is a real-time team assignment board that helps operations teams manage staff assignments, track task distribution, and send instant notifications. The Service is provided on a subscription basis with a free trial period.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Responsibilities

As a user of PulseWork, you agree to:

  • Provide accurate and complete information during registration
  • Maintain and update your account information
  • Not share your account credentials with others
  • Use the Service only for lawful business purposes
  • Not attempt to gain unauthorized access to the Service or its related systems
  • Not use the Service to transmit malware or interfere with its operation
  • Comply with all applicable laws and regulations

4. Subscription and Billing

4.1 Free Trial

New organizations are eligible for a 14-day free trial with a maximum of 5 team members. No credit card is required to start the trial. Trial organizations may have limited functionality.

4.2 Paid Subscriptions

After the trial period, you must subscribe to a paid plan to continue using the Service. Subscriptions are billed on a per-seat, per-month basis. Pricing is displayed on our website at the time of subscription.

4.3 Payment Terms

You authorize PulseWork to charge your payment method for the subscription fee. You agree to provide accurate billing information and update it promptly when changes occur.

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of the current billing period. No refunds will be issued for partial months or unused portions of your subscription.

5. Intellectual Property

5.1 Our Rights

PulseWork and all related content, features, and functionality are owned by PulseWork and are protected by international copyright, trademark, and other intellectual property laws.

5.2 Your Rights

You retain ownership of all data you submit to the Service. You grant PulseWork a license to use, process, and store your data solely to provide the Service to you.

6. Termination

6.1 Termination by You

You may terminate your account at any time by deleting your organization through the settings page or by contacting support.

6.2 Termination by PulseWork

PulseWork reserves the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activities.

6.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. PulseWork will delete your data within 30 days of termination, except as required by law.

7. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PulseWork does not warrant that the Service will be uninterrupted, secure, or error-free. You acknowledge that the Service may be subject to limitations, delays, and other problems inherent in the use of the internet.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSEWORK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL PULSEWORK'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO PULSEWORK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

Our Data Processing Agreement applies to all processing of personal data by PulseWork on your behalf and is incorporated into these Terms by reference. By using the Service, you agree to the terms of the Data Processing Agreement.

10. Modifications to Service

PulseWork reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. PulseWork will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

12. General Provisions

  • These Terms constitute the entire agreement between you and PulseWork
  • If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force
  • PulseWork's failure to enforce any right or provision of these Terms will not be deemed a waiver of such right
  • You may not assign or transfer these Terms without PulseWork's prior written consent
